Ginette Muller

Safe Harbour Practitioner and Pre-restructuring Advisor

  • Safe Harbour
  • Small Business Restructuring (SBR)
  • Director’s Advocate
“Not every director knows their Corporations Act responsibilities, which can be a problem when dealing with insolvency practitioners who prioritise other stakeholders before directors. That’s why I’m here.”

Ginette is the ideal professional for pursuing all viable best options in the interests of her clients.

Ginette Muller supports business creditors with her strong moral code and sense of justice. She is single-minded in pursuing a fair outcome for her clients, in particular where losses have resulted due to the insolvency of a business. For example, creditors will often give up chasing assets, leaving it to the liquidator. Ginette knows there are better options for her clients, all of which must be examined.

Advocating for directors

Pre-restructuring advice and qualification for SBR.

Protection for directors using Safe Harbour.

Closing a business in Australia at minimum cost and stress.

Justice when subject to illegal unconscionable conduct.

Qualifying for SBR

The process of qualifying for SBR (Small Business Restructuring) can be complex. In the first instance, the company’s admissible debt must be under $1 million and tax and employee entitlements must be paid and returns up to date.

But there are other requirements. For example the company or the director must not have used SBR within the past seven years. It’s also likely a lump sum payment or a payment plan will be required and that the majority of creditors agree to the SBR. Ginette works through the maze, easing the burden for business owners during a challenging period.

Safe Harbour protection for company directors

Unforeseen circumstances can push a profitable business into financial trouble. An important customer owing you money falls over and you have to absorb an unexpected loss. You realise you need to cut costs, which limits your ability to regain your position. Safe Harbour can protect you now, while you work to recover your position.

Winning justice via unconscionable conduct

If a party to a contract is deliberately misled and disadvantaged to the advantage of another party, they can be guilty of the serious act of unconscionable conduct. Outcomes of proving guilt include cancelling the contract, a compensation payment to the disadvantaged party, an ACCC investigation and significant penalties for the guilty party.
